These Terms and Conditions apply when you access the Marty Mone Music website or purchase physical merchandise, digital downloads or other products through our online store.
By placing an order, you agree to these Terms and Conditions. Nothing in these terms limits your rights under Irish or applicable EU consumer law.

Our online store is hosted by Shopify, which provides the ecommerce platform used to sell our products.
2. Products
We take reasonable care to ensure that product descriptions, photographs, prices and other information displayed on the website are accurate.
Product images are provided for illustration. Colours and appearance may vary slightly depending on your screen or device.
All products are subject to availability. We may limit quantities, discontinue products or correct errors in product information where reasonably necessary.
3. Prices and charges
Prices are displayed in the currency shown on the website.

Delivery charges are not included in the displayed product price unless stated otherwise. Any applicable delivery charges will be shown during checkout before you place your order.
Customers ordering from outside the European Union may be responsible for customs duties, import taxes or other local charges. These charges are not controlled by Marty Mone Music and are the customer’s responsibility.
4. Placing an order
When you place an order, you are making an offer to purchase the selected products.
You will receive an automated email acknowledging your order. This acknowledgement does not necessarily mean that your order has been accepted.
A contract is formed when we accept your order and confirm that it is being processed or dispatched, or when a digital product is made available to you.
We may refuse or cancel an order where:

The price or product information contains an obvious error.

Payment has not been authorised.

We reasonably suspect fraud or misuse.

We cannot deliver to the address provided.
If payment has already been taken for an order we cannot fulfil, the relevant amount will be refunded.
5. Payment
Payment must be completed using one of the payment methods available at checkout.
Payments are securely processed through Shopify and the relevant payment provider. Marty Mone Music does not directly receive or store complete payment-card details.
You confirm that you are authorised to use the payment method supplied with your order.
6. Physical-product delivery
Orders for physical products will be delivered to the address provided at checkout.
Estimated delivery times are provided as guidance and are not guaranteed. Delays may occasionally occur due to postal services, couriers, customs, weather or circumstances outside our reasonable control.
Customers are responsible for supplying a complete and accurate delivery address. Additional delivery costs caused by an incorrect or incomplete address may be charged to the customer.

7. Digital downloads
Digital products are delivered electronically and no physical item will be posted unless the product description expressly states otherwise.
Customers are responsible for:

Providing a valid email address.

Ensuring their device and software can open the stated file type.

Downloading and securely storing purchased files.

Keeping download links private.
Digital products are supplied for personal, non-commercial use only unless a separate licence expressly permits another use.
You must not copy, share, resell, distribute, upload, publish or commercially exploit a digital product without written permission from the relevant rights holder.
8. Cancellation rights for physical goods
Consumers purchasing most physical goods online generally have the right to cancel the purchase within 14 days of receiving the goods, without giving a reason.
You must inform us of your decision to cancel within the applicable cancellation period. You then have a further 14 days to return the goods.
Certain products may be excluded from change-of-mind cancellation rights, including:

Personalised or custom-made products.

Sealed audio, video or software products after the seal has been broken.

Products that cannot be returned for health or hygiene reasons after being unsealed.

Other products lawfully excluded from the cancellation right.
Returned products should be handled carefully and returned in their original condition where reasonably possible. You may be responsible for any reduction in value caused by handling beyond what is necessary to inspect the product.

9. Cancellation rights for digital content
Where digital content is supplied immediately, you may be asked during checkout to expressly consent to delivery beginning before the end of the 14-day cancellation period and to acknowledge that your cancellation right will be lost once the download or access begins.
Where this consent and acknowledgement have been properly provided, you will not normally have a change-of-mind cancellation right after downloading or accessing the digital content.
This does not affect your legal rights where digital content is faulty, inaccessible, not as described or otherwise fails to conform to the contract.
10. Faulty, damaged or incorrect products
You are entitled to receive goods and digital content that conform to the contract and meet the standards required by applicable consumer law.
If an item arrives damaged, faulty or incorrect, contact us as soon as reasonably possible and include:

Photographs where relevant.
Depending on the circumstances and your statutory rights, an appropriate remedy may include repair, replacement, a price reduction or refund.
Nothing in these Terms and Conditions excludes or restricts your statutory consumer rights.
11. Returns and refunds
Returns and refunds are handled in accordance with our Returns Policy and applicable consumer law.
Approved refunds will normally be returned to the original payment method. Processing times may vary depending on the payment provider or financial institution.
Original standard delivery charges will be refunded where legally required. Additional costs resulting from a customer selecting a more expensive delivery option may not be refundable.
12. Intellectual property
Unless otherwise stated, the website and its content—including music, recordings, photographs, videos, artwork, logos, graphics, text and digital downloads—are owned by or licensed to Marty Mone Music and are protected by intellectual-property law.
You may use the website for personal, non-commercial purposes. You may not reproduce, modify, republish, distribute, sell or commercially exploit website content without prior written permission.
Purchasing a physical or digital product does not transfer ownership of the intellectual-property rights associated with that product.

These services are independently operated and may have their own terms and privacy policies. Marty Mone Music is not responsible for the content, availability or practices of external websites.
15. Website availability
We aim to keep the website accurate, secure and available, but we cannot guarantee that it will always operate without interruption or error.
We may temporarily suspend or change parts of the website for maintenance, security, technical or operational reasons.
We are not responsible for delays or failure caused by events outside our reasonable control. Nothing in these terms excludes liability that cannot lawfully be excluded.

Personal information is handled in accordance with our Privacy Policy.

We may update these Terms and Conditions when our products, website, service providers or legal obligations change.
The terms applying to an order will normally be those published on the website when the order was placed. The latest version will be displayed on this page with its updated date.
18. Governing law
These Terms and Conditions are governed by the laws of Ireland.
Any dispute will be subject to the jurisdiction of the Irish courts, without depriving consumers living elsewhere of any mandatory protections or rights available under the laws applicable to them.
